INSURANCE COVERAGE FOR VIRTUAL TRAINING
(Amendment for Current Program Participants in response to COVID-19)
The U.S. All Star Federation, in cooperation with Insight Risk Management and K&K Insurance Group, working on behalf of its members who utilize the USASF Gym Insurance Program to secure their liability and excess participant accident insurance have received approval to amend coverage to include Virtual Training so long as they meet the guidelines outlined here.
The intent of this amendment is to provide coverage for operations that involve live online streaming/real-time instruction or training with the gym program clients/members via the internet.
While the policy includes coverage for personal and advertising injury claims, the standard policy excludes coverage for Personal and Advertising injury claims committed by an insured whose business is advertising, broadcasting, publishing or telecasting. While it may sound strange, we are concerned with the addition of the virtual classes/training it might be construed that you are engaging in broadcasting or telecasting activities related to the delivery of those virtual classes. Historically the insurance industry has viewed those activities as needing separate coverage, i.e. media liability and cyber liability coverage, which you do not have. It is difficult to confirm coverage under the policy provision without an actual claim. Contact Insight Risk Management if you have questions regarding these coverages.
Media liability may include defamation, invasion of privacy, copyright infringement, plagiarism, intentional torts and related liabilities. Whether you are an online blogger, film producer, advertising company, news publisher, digital marketing company, or social media influencer, a media liability policy protects you from claim types that are unique to media professionals and for which you can be held financially responsible.
Cyber liability, may include liability for someone hacking into your computers, website or servers; accessing data on your customers even if held in someone else’s cloud environment; ransomware; notification and credit monitoring expenses; forensic investigation costs, electronic funds transfer fraud; being tricked into paying fake invoices; loss of income as a result of your infected computers preventing you from being able to operate; regulatory fines and penalties for not keeping your cyber policies, protections, etc. up to the standard required by the individual States you operate in; and public relations and crisis management expenses.
If your club secures insurance through a different entity, we recommend you reach out to your insurance provider to determine if your policy can be amended to cover such training.
